On February 22, 2010, an immigration judge granted asylum to a Lin & Valdez client after a trial on this case in the immigration court.
This case involves a very unique situation of our client who is in his fifties from an Asian country. While our client's initial persecution from his country arose from his run-in with the country's population control policy, it is the later consistent economic persecution from that country forced him to flee to the US.
Our client in this case has a son. However, as his son is overweight, the doctors had diagnosed that the chance for the son to generate children would be slim. As such, out client petitioned to his country for approval to have another child, but the petitions were denied repeatedly. Because of his persistence in petitioning, the government labeled him as a "problem" person and started finding trouble with him. The persecution caused him loss job after job. Eventually our client was left with no choice but to flee from his country.
Although the persecution our client experienced does not fall into the traditional concept of persecution, i.e. bodily injury, his persecution was consistent and left him with no means of having a living. In the trial, the government counsel for BICE tried very hard to characterize our client as an "economic refugee”, i.e. a person who just comes to the US to make money, we earned over the judge and proved that it is a economic persecution case.
