Success Story: BIA Remanded to Immigration Court A Case We Appealed

Last week we received a Board of Immigration Appeal’s decision remanding to the Houston Immigration Court a case we appealed to the Board for our client.  This has been one of many successes we had with the Board.

 

In its three-page opinion, the Board sided with us on all the major issues about the case.  Our client in this case is a Christian who was persecuted in his country.  Despite of our strong protest during the merit hearing, the immigration judge made ruling finding Respondent not credible and finding him failed to establish a nexus to a protected ground.  To those denial grounds, we appealed to BIA.

 

In its ruling, the Board agreed with us that the immigration judge mischaracterized our client’s testimony and did not consider his explanation. The Board further rejected the immigration judge’s finding that attending unregistered church was a participation in illegal activities, and the consequent arrest was not on account of religious ground. Because of our success in appeal, our client now has the chance again to prove in the immigration court the merit of his case.
