Success Story: Lin & Valdez Hired to Rescue Difficult E-2 Case

On October 9, 2009, the US Consulate in Taiwan approved an E-2 petition we were hired to save.  The success in this case again proved our expertise in investor visa proceedings.

 

Before hiring Lin & Valdez, the client of this case has experienced tremendous frustration, and when she first talked with us, she was in tears.

 

The client previously hired an attorney to file an E-2 change of status application in the US.  The application sent to the USCIS contained only minimum amount of information and document.  Nevertheless, the case was approved by the USCIS.  When the client consulted with her attorney, she was told by the inexperienced attorney that everything is fine and she could just go to the US Consulate.  She was told that she would be guaranteed of the E-2 visa with the USCIS approval. 

 

The client hence experienced traumatic interview experience in the consulate.  To start with, the client did not have any document to prove source of fund.  Further, the client was not prepared to answer any question about the business reason and ground she offered certain amount of money to purchase a business, a newly incorporated scrap metal trading company. Worst of all, there was a convoluted story about the capital arrangement of her investment and she was not advised to prepare for answering all these questions.

 

Upon the refusal, the client called her attorney, but the attorney has since refused to take her phone calls.  Trapped in Taiwan, and with her business hung up in the US, client through reference came to us.  We firstly reviewed her application package, and found that the package was shockingly insufficient for consulate interview.  We then discussed all business reasons of the purchase, and instructed client to prepare a whole new package.  The new package includes detail communication, negotiation, business transaction, capital arrangement, and personnel documents.  Finally, we had a series of international conference calls and email exchanges to prepare our client for the second interview.  Although we know that the chance is not high for the second interview, our client succeeded in the second run nonetheless.  Her joy and happiness upon learning the approval was beyond description!
