On November 8, 2006, USCIS announced that it will begin accepting premium processing requests for Form I-140 Immigrant Petition for Alien Worker, involving EB-1 Aliens with Extraordinary Ability beginning November 13, 2006. In order to request premium processing, petitioners must submit Form I-140 along with Form I-907, Request for Premium Processing Service, and a $1000 processing fee.
This is certainly a very good news to self-petitioning aliens for employment-based immigrant benefit. Previously the USCIS gradually expanded the categories that can apply for premium process, but only extend to categories needing employer sponsorship. With this announcement, people qualified for EB-1 would be able to self-petition and know the result fast. People qualified as aliens of extraordinary ability will be able to know within 15 days after the case is filed whether he or she will obtain permanent residency and as such will not have to be tied up by uncertainty. We hail the USCIS’ decision and believe this is a right policy decision. However, we believe the premium processing should be further expanded to National Interest Wavier (NIW) applications and believe this will happen soon.
