Success Story: NIW Approved by NSC 4 Days After RFE Was Responded

On January 28, 2009, Nebraska Service Center approved an NIW application we filed for a thermoplastic composites researcher.  The approval was issued by the NIW within a week after we responded to the Request for Additional Evidence from the NSC.

 

As we mentioned before in our column articles, the USCIS is more and more emphasizing and focusing on the publication citations and using it as an indicator to decide whether an NIW applicant has a degree of influence over his peer researchers in his field.  The USCIS tends to use the number of citations on the researchers・ publication to decide whether national interest would be adversely affected if NIW is not granted to the applicant.  In this case, the USCIS also asked for such evidence from our client.  Our response to the RFE, however, goes beyond the boundary set by the USCIS. 

 

As the citations to our client・s publication are not too many, we tried to direct the processing officer・s attention to our client・s other achievement.  The response we sent back, among others, includes attestations from experts on the achievement of our client and importance of his research, a memo from the US Department of Energy, and even a supporting letter from a professional association to which our client is a member.  We also analyze in great detail why citation alone does not show the importance of our client・s research.  All the points were presented in a persuasive manner and obviously our presentation convinced the officer. 

 

It has long been believed that the Nebraska Service Center applies a stricter examination standard and as such many clients worry about filing their petitions to NSC.  However, over the years we have been known for our detail and extensive preparation for a filing.  For each case, we analyze the uniqueness of the petition, and painstakingly prepare detail but to-the-point petition letter for our client.  Our countless approvals in EB-1, NIW, and O-1, both from NSC and TSC, have proved the success of our method.  We always believe that if a case is prepared right, it does not matter where it is filed and we have proved our record.
