On July 1, 2010, the Department of State sent out to Lin & Valdez a final J-1 Waiver approval to a case we applied for our client. This notice completed a complicate J-1 waiver procedure.
Previously on March 19, 2010, the Department of Health & Human Service as the interested government agency had approved our J-1 Waiver Application, and agreed to request a waiver from the Dept. of State of the foreign residence requirement to our client.
Our client in this case is a researcher in environmental toxicology who published 23 journal-reviewed papers. On J-1 status, she was under the Sec. 212(j) two-year foreign residency restriction before she can apply to change her status to H-1 or apply for permanent residency.
The petition we filed for the client to the DHS was comprehensive and detailed. The filing package was about two inches thick, and composed about 50 documents of various nature. It took the DHS about 8 months to issue the approval, and the Dept. of State another 4 months to approve the requested waiver.
