Last Thursday on Oct. 12, 2006, another PERM labor certification case we filed was certified by DOL. This application is for the position of Senior Software Engineer for a company in northeast part of the US. The unusualness of this case is that while all the other cases we have filed were certified between 5 to 120 days after filing (except two pending cases converted from RIR requesting for carryover of existing priority case), this case was pending for 6 months without any reason given by DOL!
This case marks another success of a long list of approvals Lin & Valdez has obtained in PERM labor certification area. As a matter of fact, except the two cases afore-mentioned which were converted from RIR with request for preserving existing priority date, and those filed within the past 90 days, all the PERM cases we handled and filed for our clients have been certified.
The irony of this case is that the application for another employee of the same company was filed much later but was certified in 30 days, and this case was filed earlier but pending for 180 days. The DOL did not give any reason for such a long pending, nor did it request for audit or for additional information. To facilitate the processing of this case, we sent 4 inquiries to DOL and finally received the certification on Oct. 12, 2006. Needless to say, our client is greatly excited.
