H-1B Cap Still Amply Available for Application

On June 24, 2009, AILA releases an update from the USCIS about the current H-1B cap usage.  According to the USCIS, as of June 19, 2009, approximately 44,500 H-1B cap-subject petitions had been received by USCIS and counted towards the H-1B cap. Approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits.

Readers may found strange as to the released number because on June 12, 2009, the announced cap-subject petitions received by the USCIS is 44,400, and on May 29, 2009, the number is 45,800.  In other words, the number of cap-using petitions has decreased, rather than increased.  The USCIS explains that it is because some received cases have been withdrawn or denied.  Therefore, there is still ample cap available for application.
