9-Year Wait Ahead of Aliens Granted Conditional Asylum Based on CPC In 2004

According to a notice recently sent to aliens who were granted conditional asylum based on CPC (Coercive Population Control), the waiting period for full asylum benefits for those granted conditional asylum based on CPC in 2004 is about 9 years as there are about 9,000 people on this list.


The U.S. immigration law limits the number of aliens who can be granted asylum based on CPC to 1,000 per fiscal year. Asylum is granted to such aliens on conditional basis by Immigration Judges and the Board of Immigration Appeals (BIA), or by asylum officers. Aliens who annually establish eligibility beyond the 1,000 cap are placed on a waiting list and remain in conditional grant status until final approval becomes available.


The above-mentioned notice was sent to aliens in the U.S. with conditional grants of asylum based on resistance to CPC who are now fully eligible for all asylum benefits. Aliens who were granted conditional asylum by September 15, 2000, but have not received a notice regarding the final asylum approval should check on the status of their approval.  If you would like to know more details on how to check your status please contact our office.
